Nokia Sues RIM to Implement Arbitration.

Nokia sued Cell phone maker Research In Motions Ltd. (RIM) in California to enforce a global arbitration award governing this sale of WLAN- compliant phones.

A Swedish arbitration judge ruled Nov. 6 that RIM isn’t eligible to make or sell products appropriate for the WLAN standard without first agreeing with Nokia with royalties. Mobile phones while using the technology allow users to switch to wireless local place networks where available.

“Nokia and RIM haven't agreed on the royalty to be paid, ” Nokia said in the complaint filed Nov. twenty six in federal court with San Jose. “RIM and it is U. S. subsidiary RIM Corp. nevertheless continue to help violate the award in addition to breach the underlying deal. ”

Crystal Roberts, the RIM spokeswoman, said it’s company policy not to comment on pending law suit.

Enforcement of the award is governed with the New York Convention signed with the U. S., Finland, Canada and Sweden, Nokia mentioned. Nokia, based in Espoo, Finland, seeks a court order credit reporting the award and making Waterloo, Ontario-based RIM to cover its court costs in addition to attorneys’ fees.
